This website is operated by McCullough Estate. Throughout the site, the terms “we”, “us” and “our” refer to McCullough Estate. We offer this website, including all information, tools, and services available from this site to you, the user, conditioned upon your acceptance of all terms, conditions, policies, and notices stated here.

Section 1 - Vintage and Antique Condition (As-Is)

By purchasing from our store, you acknowledge and agree to the following regarding our inventory:

  • Unique Nature: The items sold on this website are vintage, antique, or pre-owned collectibles, tools, and furniture.

  • Wear and Tear: Due to their age and history, items will naturally exhibit signs of wear, use, aging, and minor imperfections.

  • Descriptions: We make every effort to accurately photograph and describe the condition, maker's marks, and specifications of each item. However, all items are sold strictly on an "As-Is" and "As-Found" basis. It is the buyer's responsibility to review all photos and descriptions carefully prior to purchase.

Section 2 - Inventory and Availability

Because our inventory consists primarily of estate liquidation pieces and unique collectibles, most items are strictly limited to a quantity of one. In the rare event that an item is cross-listed and sells simultaneously on another platform before our website inventory updates, we reserve the right to cancel the transaction and issue an immediate, full refund to the buyer.

Section 3 - Shipping and Handling

  • Carrier Selection: We primarily utilize USPS and FedEx to fulfill and ship orders safely.

  • Calculated Rates: Shipping fees are calculated at checkout based on the package dimensions and weight of the specific item.

  • Packaging: Due to the fragile or unique nature of vintage goods, we take extreme care in packaging items securely. We are not responsible for transit delays or carrier handling once the package leaves our possession.

Section 4 - Accuracy of Billing and Account Information

We reserve the right to refuse any order you place with us. We may, in our sole discretion, limit or cancel quantities purchased per person, per household, or per order. In the event that we make a change to or cancel an order, we may attempt to notify you by contacting the email provided at the time the order was made.

Section 5 - Governing Law

These Terms of Service and any separate agreements whereby we provide you services shall be governed by and construed in accordance with the laws of the State of Tennessee.
